If having nudes on your phone, which might not have even been condoned by you, is criminal then me seeing a young person on the internet post a nude of him/herself on a forum should be criminal.. which makes no sense.

No, it would only be criminal if you had the picture in your possession (on your computer).

I don't see anything wrong with them charging people for having the possession of CP on phones but the male teens aren't even over 18. :/

In the case of 'sexting', the person who sent the picture (though still charged criminally) is legally considered the victim, while the person who received the picture, knowingly or not, is the suspect. The whole thing is nuts. Parents need to sit down with their kids and confront the issue. I'd tell my kids (if I had any) not to take pictures of yourself in compromising positions or let someone take your picture in a compromising position. That goes for more than just nude pictures.

depending on your settings, that image would be saved to your temporary files.. but eh, I get what you're saying and I guess you are correct.

still, the thought of the viewer/one that has it in his/her posetion (possibly unintentional/unknowingly) being seen as the wrongdoer holds up in my partly flawed example.
it's just wrong.

I'd probably lock my children in their rooms if they were sending nudes at 13.
